The following terms and conditions (these "Terms of Service") govern your access to and use of the Bri Maejor Designs website, including any content, functionality, and services offered on or through  (the "Site")

These Terms of Use (“Agreement”) set forth the legally binding terms for your use of the Site and Services (whether as a Designer or as a Customer). By registering for Services, you are accepting this Agreement and you represent and warrant that you have the right, authority, and capacity to enter into this Agreement.

Work: 
 
Bri Maejor Designs agrees to produce project materials (the “Work”) at the request of the client for fees agreed upon in advance and delivery of the Work by an agreed-upon deadline. As long as the client provides the designer with all information, items, images, and materials needed to do so within the allotted time frame. Bri Maejor Designs agrees that she will be the sole author of the Work. We do not copy or duplicate any designs.


Compensation:
 
The client agrees to pay Bri Maejor Designs 100% of the total project cost before any services are provided.

Communication:

We typically do not contact you right after purchases unless further clarification is needed or until the first drafts are prepared. We communicate via email only at brimaejordesigns@gmail.com for paper trail purposes. We do not accept phone consultations. Please allow 24-72 business hours for a reply to your inquiry. Inquiries will not be responded to on the weekends. For updates regarding your order, visit your Client Portal. Details are sent via email that was provided.


Revisions:

There is a free three (3) minor revision limit. After that, all additional revisions will incur a $25 fee per revision. Revisions are minor changes like color, font, and placement. It doesn’t include a new design.  We will not produce any other concepts out of the 1-3 we've already designed, you must choose one (1) design to revise UNLESS a new design has been purchased. After revisions have been submitted, please allow 3-5 business days to complete. For larger-scale projects like web design, the number of revisions is limited to 4. This is to ensure a steady workflow so your project can be completed in a reasonable time frame.


Rough Drafts Ownership:

Rough draft images of ANY kind are for the purpose of approval only. They may not be copied, manipulated, or distributed to any other person or company other than those directly involved with the project without prior permission from Bri Maejor Designs, LLC. All drafts works are the property of Bri Maejor Designs, LLC.


Turnaround Time:
 

The estimated turnaround time for custom designs is between 7 - 14 business days, for web designs and branding packages, anywhere between 6 - 8 weeks, and are subject to change. Turnaround time starts after all information has been received. Delay in us getting all the information necessary can result in a delay in your project being completed in the time frame mentioned above. 

Illness, injury, or other events beyond Bri Maejor Designs, LLC’s control such as fire, theft, computer failure, and Acts of God may result in a delay of unpredictable length. We will be sure to keep you updated during the process.

Client Response Time + Time Frame To Obtain Materials:
 
“The Client” must provide all information requested for the project in a timely manner. If there is a delay on your behalf, the completion date of your project then changes. All project forms/materials must be completed and submitted within 5 business days after the purchase date.


Drafts & Proofs

A steady flow of communication is needed in order to ensure that you receive your designs in time. There is a 72 hour period for you to respond to any drafts, proofs, or revisions. Once this window has passed, there is a day-for-day extension added to your turnaround time. We are aware that life happens, and unforeseen circumstances may occur, we just ask that you kindly notify us!
Ghost Policy

If “The Client” fails to respond for whatever reason, we will mark the project complete, forfeiting the initial deposit. This falls under our “Ghost” policy.

After 30 days of no communication, there will be a $100 restart fee.

After 60 days, your project (deals, credits, and/or free offers) is forfeited, and no refund shall be issued. Your entire project is now canceled and any design or coding will be removed from the server.

Any time your project comes to this extreme decision, our company will no longer do business with your brand.

We know certain information takes time to acquire to email us & we also know life happens, which we respect and will place your project to start later than scheduled if communicated. All we ask is to be courteous & keep in contact and reiterate that you need more time to gather information for the project and/or to submit changes during the revision stage.

In good effort, our team will ONLY send 1 “courtesy check-in” (dated email) if we have not heard from you within 35 days of the initial invoice.

For ALL projects, all material, products, and other information that was requested in your design form must be submitted before the project is completed. Any details regarding an order sent through any social media platform such as Instagram, Facebook, etc. will be null and void. If the requested information is not submitted once completed, You, “The Client” are responsible for uploading any remaining information and/or products.



Deliverables:


For custom logo designs, after the final logo design is approved, the logo will be sent to you as a digital file in the following formats: (.jpeg, .pdf, .png). PSD & AI files are the sole property of Bri Maejor Designs, LLC. If for any reason you need the PSD/AI files for a printer/manufacturer, we will send the files to them personally please just provide the contact information. 

Other services: JPG and/or PDF files will be sent.

Logo Ownership:


After the final logo design is approved & finalized, the Client has full ownership of the logo. It is up to the client to obtain a trademark + legalities.

Cancellation:


If for any reason you want to cancel a service already rendered or paid for, that is your choice. However, due to the work produced or in queue, payments already received by Bri Maejor Designs, LLC will not be refunded in order to offset the loss of business.

If partial work has already been received by the client and they choose to cancel, the partial or full payment that has been paid will not be refunded. Ownership of all artwork, layouts, and development will remain the property of Bri Maejor Designs, LLC and remaining work will not be sent to the client for their ownership. If the project is in its final stage, ownership will be transferred to the client after full payment is received.


Termination of Service: 


The client has one week to respond to our emails and proofs. After this grace period, the order will be terminated, and the client will have to pay a restart fee of $100. Waiting on responses/decisions hinders us from closing out projects and moving on to new clients. We understand that life happens. Just openly communicate that with us. Trust, we will do our best to work with you.
 
The client has the right to terminate this agreement if, Bri Maejor Designs, LLC fails to fulfill service requests within the given turnaround time. If the agreement is terminated for any reason from the client other than failure to deliver within the given turnaround time, Bri Maejor Designs, LLC shall retain the payment and cancel the order. Bri Maejor Designs, LLC also has the right to terminate this agreement and retain payment if a client becomes verbally abusive, unreachable, procrastinates, and absurd.
 
**This agreement can also be terminated by Bri Maejor Designs, LLC for the following reasons:
 
1. Rejection of several designs without giving sufficient criticism or suggestions, leaving the designer to guess what they dislike (“I don’t know what’s wrong. I just don’t like it.”)
 
2. Requests features that were not in the original agreement, and then refuses to pay for extra services rendered.
 
3. Makes unreasonable requests, usually with delivery time (“I would like four different versions of the website by tomorrow night, thank you!”)
 
4. Is unable to make decisions, forcing the designer to make constant changes to the design.
 
5. Overly-contact and harassment
 
In the event of termination of this agreement, Bri Maejor Designs, LLC owns the design and has the right to consummate, exhibit, and/or sell the design (not including business name). Furthermore, Bri Maejor Designs, LLC owns all the design concepts engendered before the final design. The client understands that once the invoice is paid in full, the client has the right to utilize the design in all media subsidiaries for business promotion and that Bri Maejor Designs, LLC reserves the right to exhibit the design for business promotional use.

 
Refunds: 
Deposits and payments are 100% Non-Refundable.
Due to the fact that we provide a custom service, the time that it takes to create designs is non-refundable. Our time is valuable and so is yours so please communicate professionally and responsibly of your design expectations.

Bri Maejor Designs, LLC does not provide refunds for any services unless agreed upon. Having buyers remorse or wanting to use another company instead is not a suitable means for a refund.

Once payment has been made to Bri Maejor Designs, LLC, the project will begin in the time frame given to the client. It is advised that you give the project a realistic amount of time for completion for these reasons: revisions may be needed, it may be a peak in the orders received and prior work received may take longer than expected. We provide a suitable timeframe, however, there may be an additional business day or two needed before we can begin if it is a busy time.
